REPORT:
Vecinos
de Benissa invited the Mayor to a meeting attended by coastal
residents. Two town counsellors , Arturo Poquet and Jorge Ivars,
accompanied the Mayor.
After
welcoming the Mayor and his team, Lisa Svoboda announced that the AGM
which had been postponed due to illness would now take place on March
20 at which time a new management committee would be elected. She
asked for significant participation.
She
then turned the floor over to the Mayor, who provided an update of
developments in Benissa, addressed specific issues and then opened
the floor to discussion.
The
mayor touched on the following issues:- The construction of Benissa's N332 bypass would be started up again. The mayor had had a meeting in Madrid on March 5 which confirmed this.
- The EU has provided 300.000 euros to fund a new project in support of local companies and entrepreneurs whereby they will be taught to make use of new technology and know how in order to improve their competitiveness. Already 150 entrepreneurs have signed up.
- Ninety garden plots in Pla de Caralls, across from Lidl and the tanatorium, will be made available to families with an interest in and need for an urban gardening space where they may grow their own produce. A six week course on small scale farming will be offered to interested persons while the plots are being readied for agricultural use.
- The construction of the long awaited animal shelter has begun. A brochure on dangerous dogs is being prepared for publication.
- An excursion for the benefit of local residents to the Fallas in Valencia will take place on March 17. Tjhe cost is 17 euros per person.
- The mayor announced that Benissa's annual gastronomic fair would take place on March 7, 8 and 9 in the 'Taller Ivars'.
- A Mediterranean gardening course would be offered in the Aula del Mar beginning on March 6.
- Benissa's Budget 2014: As a result of the recession, Benissa's income, collected through taxes and licences, was reduced and therefore the local government was obliged to reduce its current spending. Despite this, Benissa generated a surplus of 1,6 million euros and has no new debts to speak of. Personel costs account for 40% of Benissa's budget, running expenses account for 28%, while Benissa Impuls (garbage collection, beach and street cleaning, maintenance of public buildings) accounts for 23%.
- IBI: (Note an earlier email with more details on the IBI discussion can be found at the end of this report). The mayor has had several discussions over a period of time with the Cadastral Office in an attempt to reduce the property taxes in Alicante, with no results. To exert pressure on this office, Vecinos de Benissa collected over 600 signatures from friends and neighbours. This petition was subsequently presented on February 10 to the Director of said office together with a background note prepared by Paloma Hoffmann on the issue. The mayor asserted receiving a letter confirming the reduction by 20% of the catastral value of land in the coastal zone which will result in a reduction of the IBI tax paid on land in 2015. He would also apply to Madrid for a further reduction of the value of urban property which would also include Benissa town.
- Sewage tax: A tax imposed by Valencia and added to the water bill. The mayor explained that this tax could be eliminated if property owners not connected to a sewer installed a private sewage treatment. This installation would be subject to inspection and following a favourable report this tax could be eliminated from the water bill.
- Garbage tax: The mayor stated that he had considered lowering or equalizing the rates paid for garbage collection, street cleaning, etc, but in view of reduced IBI revenues, he indicated that Benissa could not also cut the rates paid for garbage collection. With respect to the EcoParque, Benissa Impuls will no longer be allowed to create compost from ecological waste, due to the environmental contamination caused by the waste process. As an alternative, Benissa Impuls is looking into using plant material to produce biomass.
- Benissa's town plan of 2003 was annulled by a Supreme Court decision following an appeal against Valencia's Superior Court (lodged by Abusos Urbanisticos NO). Benissa in turn filed an appeal to Constitutional Court which has yet to render its decision. As a result, the Town Plan of 1982 is now in effect. In the first instance, Benissa will revise and re-present a cleaned up version of the 2003 Town Plan and submit it for public consultation, against which allegations may be presented. In the second instance, Benissa is also planning a new Town Plan as the former and now cancelled plan is more than 10 years old and out of date in view of the current economic and social climate.
- Other infrastructure investments in coastal Benissa: In 2013, Benissa invested 653,000 euros in infrastructure projects in the coastal zone, including 300,000 euros for street improvements in La Fustera. This year 900,000 euros will be spent on reasphalting and street improvement, improving personal security by installing street lights at major intersections, building a bicycle lane and sidewalks on a part of the Calpe to Moraira coastal road. Also a new roundabout at Pepe La Sal on the coastal road to Moraira, the costs for which would be shared with Teulada.
- European Elections (May 25, 2015). The mayor stated that with its multinational population, Benissa was more European than ever. He encouraged residents to vote and for those not here at that time, to avail themselves of the postal vote, prior to May.
- Over 100 persons attended the briefing.

Svoboda's notes:
-Charge for nonexistent sewage connections and lines: ie. Canon de saneamiento tax: JBRT said that those who are paying this tax attached to the water bill could probably legitimately ask to be relieved of this unfair tax. But he warned that this could trigger an inspection of current sewage treatment facilities in individual properties. If a property does not already have modern treatment arrangements – a depuradora, this may be obligatory. The cost for such a unit, according to JBRT is about €6,000 with annual maintenance of about €200. The monthly tax being charged on average is probably about €5
- IBI :
Most contentious issue of the evening. Thanks to some pressure on the
Catastro – most recently about ten days ago (when JBRT, Lisa and
Paloma Hoffman visited the office in Alicante), it seems the
catastral values of all properties in Benissa’s rural areas,
including the coastal zone will be reduced by 20% this year, meaning
that IBI will go down proportionately from 2015. JBRT said he now has
this in writing. But this reduction will apply to land only, not
construction. He hopes to achieve another cut across the board, town
and country, included, of 10% perhaps in 2015 because of the poor
state of the property market. Benissa’s good financial state will
permit the loss of about 600,000 in associated revenue without
serious impact.. Mayors and town halls are now forbidden from
adjusting the“tipo” or rates applied to catastral values, unlike
in some previous years.
- PGOU :
Given that it was annulled by the Supreme Court last June, and
evidently expecting that the Constitutional Court will not overturn
that decision, as allowed by the Supreme Court, the mayor’s
intention is to present the 2003 PGOU for public consultation “soon”
and thus open to allegations, but no date was indicated. It would
need to conform to laws and rules newer than 2003—( that includes
the LUV, etc.) so the process will be complex. At the same time work
will begin on a new one, since the 2003 plan was initially prepared
in 1998, but that will take considerable time, probably not in the
mayor’s current mandate, which expires in May 2015. Pressed on this
after the meeting, JBRT (and Arturo Poquet ,the consejal for
urbanismo) said that any PAI that had not been completely “urbanized”
and accepted by the town as “consolidated” basically has no legal
status. Assuming the 2003 PGOU is approved, whenever that is, all the
PAI that have not yet been finished-ie. at least all the
infrastructure completed would also need to be adjusted to current
norms, presented and approved once more- a process that could take
years. That also is true for any “modificacion puntual” regarding
access roads, etc. Carrions, PM2, for example had not reached that
stage- whereas the mayor claims Magraner, Raco de Galeno ,etc. are
“completed” and thus consolidated (this needs to be checked). It
may be there will be opportunities for many allegations, to be seen
when the PGOU and any subsequent PAI are presented. For the time
being the1982 town plan is the one that is legally valid so even the
sector’s names and boundaries of the failed 2003 differ from the
now familiar ones.
-Claims
for compensation:
Related to the above, both the mayor and Poquet said when I asked
them after the meeting that those who had been forced to give up land
and/ or pay infrastructure costs for urbanizations that perhaps had
been started but have not been accepted as consolidated, or for other
development plans allowed for by the town hall under the cancelled
2003 PGOU, that have not been carried out should get their land and
money returned. That will be handled case by case. I don’t know if
any property owner in Carrions is in that situation or whether for
example in PM2 compensation could be sought for legal costs, the
preparation of an alternate PAI, etc. There are a few instance where
property owners were forced to give up several square meters of land
and pay development costs, for planned roundabouts that have never
been installed. According to the mayor those should be restored to
the owners. But the proof will come when an attempt to recover such
losses is actually presented. A lawyer may be persuaded to take a
compensation claims forward on a contingency fee (no win, pay) basis.

Versammlung
des Nachbarschaftsvereines am 20.02.2014 mit dem Bürgermeister
Zu dieser Versammlung, war
der Bürgermeister und einige Stadträte von Benissa sowie alle
anderen Küstenbewohner eingeladen.
Lisa Svoboda begrüßte
die Abordnung des Rathauses und gab bekannt, dass die wegen Krankheit
verschobene Jahreshauptversammlung am 20. März stattfinden wird, bei
der auch der gesamte Vorstand neu zu wählen sei. Sie bat um
zahlreiche Teilnahme.
Dann hatte der
Bürgermeister das Wort, der zuerst über allgemeine Themen sprechen
wollte und danach eine Diskussion über spezielle Punkte ankündigte.
- Er habe sich um den Weiterbau der Umgehungstraße von Benissa (N322) bemüht und man habe ihm von Madrid auch zugesagt, dass die neue Ausschreibung noch in diesem Jahr erfolgen solle. Zu diesem Thema hat er am 5. März mit dem Ministerium einen Erörterungstermin gehabt.
- Die Europäische Kommission hat mit 300.000 € ein neues Projekt für Unternehmer aus der Region gesponsert. Dieses Projekt soll dazu dienen, die Unternehmer mit neuen Technologien und dem entsprechenden know-how vertraut zu machen, damit sie konkurrenzfähiger werden können. Hierzu haben sich bereits 150 Unternehmer eingetragen.
- In Benissa wurden 90 Parzellen - unterhalb des Tanatoriums- als Nutzgärten ausgewiesen. Damit die Bürger diese Gärten optimal nutzen können, wurde um die Kleinlandwirtschaft wieder zu erlernen, ein 6-monatiger diesbezügliche Kurs angeboten. Teilweise, sind diese Parzelle bereits vergeben.
- Die Bauarbeiten für das lange ersehnte Tierheim sind bereits im Gange. Für Halter, von gefährlichen Hunden, wurde eine entsprechende Verhaltensbroschüre ausgegeben.
- Ein Ausflug für die „Fallas“ in Valencia am 17. März wird für die Residenten angeboten. Der Teilnahmepreis beträgt 17 €.
- Am 7, 8 und 9.03 fand die gastronomische Messe von Benissa im Taller Ivars statt.
- In der Aula der Mar an der Küste wurde am 6.03. ein Gärtnerkurs angeboten.
- IBI . Seit 2008, musste die Gemeinde, bedingt durch die Baurezession und die damit verbundenen geringeren Einnahmen, ihre laufenden Ausgaben erheblich senken. Dieses mit Erfolg, so dass die Gemeinde trotzdem über 1,6 Millionen im Plus ist und keine neuen Schulden bei den Banken hat. Von den Ausgaben erreichen die Personalkosten ca. 40 %, die laufenden Ausgaben belaufen sich auf 28 % und die Benissa Impuls erhält ca. 23 %.
- IBI. Zur Herabsetzung des Katasterwertes hatte der Bürgermeister bereits viele Gespräche mit dem Katasteramt geführt. Leider ohne Erfolg. Daraufhin hat er uns um Unterstützung gebeten, unsere bereits laufende Unterschriftensammlung zu diesem Thema zu vervollständigen, um mit ihm gemeinsam beim Katasteramt mehr Druck ausüben zu können.
Man
hatte dann sehr schnell mit Hilfe von Freunden und Bekannten mehr als
600 Unterschriften gesammelt, zu denen Paloma Hoffmann einen
umfangreichen Antragsbrief bereits verfasst hatte. Am 10. Februar
fuhren dann Lisa, Paloma und der Bürgermeister zu einer Verhandlung
mit der Leiterin des Katasteramtes nach Alicante.
Die
Besprechung mit der Leiterin des Katasteramtes, Frau Margarita
Aparicio, verlief sehr konstruktiv und es wurden nachstehende Punkte
festgelegt:
- a) Es erfolgt keine neue Katasterbewertung, aber es wird - auf Antrag des Rathauses - ein Korrekturkoeffizient eingeführt, der die IBI im Küstengebiet ab dem Jahre 2015 um 20 % senken wird. Dieser Antrag wurde sofort vom Rathaus gestellt und am 19.02. vom Katasteramt genehmigt.
Dies
bedeutet, dass die Gemeinde ca. 600.000 € weniger an IBI-Einnahmen
haben wird.
- Da die wirtschaftliche Lage der Gemeinde trotz alldem zur Zeit ausgeglichen ist, untersucht das Rathaus zusätzlich , ob eine weitere IBI-Senkung um 10 % für ganz Benissa möglich ist.
- Die Kosten für die Müllabfuhr (Abholung, Behandlung und Transport) haben sich erhöht, aber durch andere Einsparungen ist es möglich, dass die Gebühren gleich bleiben. Die Diskrepanz zwischen Stadtbereich und Küste wird allerdings bleiben, weil die Abfuhr einer Tonne Müll durch die langen Wege hier wesentlich teurer ist und dazu noch die sehr hohen Kosten für die Abfuhr und Kompostierung der Grünabfälle, deren Sammelpunkte nur an der Küste sind, anfallen. Dazu sei noch gesagt, dass man zur Zeit noch nicht genau weis, was in Zukunft mit der Kompostierungsanlage geschieht, weil diese vom Gesundheitsamt wegen angeblicher Kontaminierung des Grundwassers gesperrt ist.
- „Canon de saneamiento“ (Kanalsteuer). Diese Steuer wird nicht von der Gemeinde sondern von der Behörde „Entidad de Saneamiento“ eingezogen. Gemäß einem Urteil des Obersten Gerichtes muß diese Steuer bei Nichtvorhandensein einer Kanalisation nicht entrichtet werden. Derjenige, der über eine Hauskläranlage verfügt, braucht diese Steuer ebenfalls nicht zu entrichten. In diesem Fall muss man jedoch mit einer Inspektion rechnen. Die Reklamationen diesbezüglich werden im Rathaus entgegengenommen.
- Der Bebauungsplan (PGOU) aus dem Jahr 2003 wurde aufgrund eines Urteils des Obersten Gerichtshofes im Jahr 2013 annulliert. Die Gemeinde von Benissa hat gegen dieses Urteil Einspruch erhoben, um diesen Bebauungsplan zu erhalten. Außerdem wird demnächst ein neuer Bebauungsplan vorgelegt; den Bürgern wird genügend Zeit eingeräumt, um ihre Einwände geltend machen zu können wie dies das Gesetz es vorsieht.
- Die Investitionen für die Küste in 2014 belaufen sich auf 900.000 €. Der Kreisel am Pepe La Sal ist bereits genehmigt. Ein Fuß- und Radweg zwischen Los Bassets und Cala Pinet wird ebenso gebaut. Viele Straßen im Bereich La Fustera und Buenavista werden neu asphaltiert (ein Verzeichnis derselben ist im Rathaus vorhanden).
- Die Europawahl findet am 25. Mai statt. Es wird um zahlreiche Teilnahme gebeten. Eine Wahl per Brief kann bis zum 15. Mai erfolgen.
- Anschließend beantwortete der Bürgermeister Fragen der Anwesenden, bei denen es sich überwiegend um Beschwerden zur zu hohen IBI handelte.
